Membership Agreement &
Liability Waiver

MEMBER AND GUEST AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND FACILITY RULES

1. ACKNOWLEDGMENT OF RISKS

Member understands and acknowledges that participation in golf simulator activities and use of Facility equipment involves inherent risks, including but not limited to:

  • Swinging golf clubs

  • Being struck by golf clubs, golf balls, or equipment

  • Slips, trips, and falls

  • Equipment malfunction or misuse

  • Physical injury resulting from athletic activity

  • Injury caused by other participants or guests

  • Risks associated with unattended or 24-hour facility access

Member voluntarily accepts all risks associated with the use of the Facility and participation in all activities.

 

2. RELEASE OF LIABILITY

To the fullest extent permitted by law, Member releases, waives, and discharges the Facility, its owners, managers, employees, contractors, affiliates, agents, and representatives from any and all claims, demands, damages, causes of action, losses, liabilities, costs, and expenses arising from or related to:

  • Personal injury

  • Property damage

  • Illness

  • Death

  • Theft or loss of personal property

  • Use of equipment

  • Use of the Facility

Whether caused by Member, guests, other participants, or ordinary negligence of the Facility.

 

3. MEMBER RESPONSIBILITY FOR GUESTS

Member agrees to:

  • Remain present while guests are using the Facility.

  • Ensure guests comply with all Facility rules.

  • Accept full responsibility for the conduct of all guests.

  • Assume liability for damage caused by guests.

  • Ensure all guests agree to this required waiver prior to participation.

The Facility may revoke guest privileges at its discretion.

 

4. FACILITY RULES

Member agrees to:

  • Use equipment only as intended.

  • Refrain from reckless or unsafe conduct.

  • Follow all posted safety instructions.

  • Maintain awareness of others while swinging clubs.

  • Use only clean golf clubs and golf balls approved by the Facility.

  • Report damaged equipment immediately.

  • Respect reservation policies and time limits.

The Facility reserves the right to suspend or terminate memberships for violations of Facility rules.

 

5. 24/7 ACCESS POLICY

Members granted after-hours access acknowledge:

  • Facility staff may not be present during all hours of operation.

  • Member is responsible for personal safety while using the Facility.

  • Surveillance cameras will be in operation.

  • Access credentials may not be shared.

  • Unauthorized entry by non-members is prohibited.

  • Violations may result in immediate termination of membership without refund.

 

6. DAMAGE TO FACILITY OR EQUIPMENT

Member agrees to be financially responsible for any damage caused by:

  • Intentional misconduct

  • Negligence

  • Violation of Facility rules

  • Unauthorized guests

The Facility may charge the payment method on file for repair or replacement costs, subject to applicable law.

 

7. MEMBERSHIP TERMS

Member acknowledges:

  • Membership benefits are subject to posted rules and availability.

  • Peak and off-peak restrictions may apply.

  • Membership hours do not roll over unless specifically stated by the Facility.

  • Reservations are subject to availability.

  • The Facility may modify operating rules, benefits, pricing, or membership programs upon reasonable notice.

 

8. PHOTO AND VIDEO CONSENT

This facility utilizes security cameras throughout the premises (inside and outside).

Member grants permission for photographs or video recordings taken during events, leagues, or tournaments to be used for promotional and marketing purposes unless Member provides written notice opting out.

 

9. INDEMNIFICATION

Member agrees to indemnify and hold harmless the Facility from any claims, damages, liabilities, costs, or expenses arising from:

  • Actions of members and/or their guests

  • Violations of Facility policies by members and/or their guests.

  • Misuse of equipment or property by members and/or their guests.

 

10. EMERGENCY MEDICAL CARE

In the event of an emergency, Member authorizes the Facility to secure medical assistance on Member's behalf. Member accepts financial responsibility for any resulting medical expenses.

 

11. GOVERNING LAW

This Agreement shall be governed by and construed under the laws of the State of Montana.

If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.

12. ACKNOWLEDGMENT

By purchasing a membership and scheduling tee times with Fore06 Golf, LLC, Member acknowledges that:

  • Member has read and understands this Agreement in its entirety.

  • Member understands the risks associated with golf simulator activities.

  • Member voluntarily agrees to make all guest aware of Facility rules and policies.

  • Member and guests voluntarily agree to all Facility rules and policies.

  • Member and guests agree freely and voluntarily
